Section 180 starts with the rule that your policies are approved by the governing body, then lists what they must include at a minimum. An RN-written plan, with the client and family, covering the six listed elements; kept in the record, given to the client and reviewed with the assigned home attendant before services start.

Report suspected adult abuse immediately

Staff paid to care for adults are mandated reporters and must report suspected abuse, neglect or exploitation immediately to the local department of social services or the APS hotline (888-832-3858, 24/7), orally or in writing, with all information behind the suspicion.

"Matters giving reason to suspect the abuse, neglect or exploitation of adults shall be reported immediately upon the reporting person's determination that there is such reason to suspect."

Employer duties to mandated reporters

Do not prohibit staff from reporting directly; tell employees about the duty to report when they are hired.

Proposed changes to 12VAC5-381

VDH lists two regulatory actions for the home care organization regulations. Neither is in force:

  • A broad update combined with a periodic review. A standard regulatory action combined with a periodic review. The State Board of Health approved proposed amendments on December 10, 2021; they are under Executive Branch Review, with the comment period still to be set. VDH

Frequently asked questions

Does Virginia publish a list of required home care policies?

Yes. 12VAC5-381-180 lists the topics a home care organization’s written policies and procedures must include, at a minimum: administrative and operational, financial, personnel, and admission and discharge. Other sections of the regulation add detail, for example client rights, complaints, infection control and records.

How many policies does a Virginia home care organization need?

It depends on how you group them. We map 85 requirements from 12VAC5-381 and the Code of Virginia onto 35 policies in 10 manual sections. A few apply only if you do that activity, such as medication assistance, telemonitoring, contractors or drop sites.

How often must Virginia home care policies be reviewed?

At least once a year, with recommended changes submitted to the governing body for approval.

Who approves the policies?

The governing body, which is legally responsible for the organization’s management, operation and finances, approves the written policies and procedures and reviews them every year.

Can clients see our policies?

Yes. Policies must be available for review, on request, to clients and their designated representatives, and readily available to staff at all times.

How long must client records be kept in Virginia?

At least five years after discharge or the date of last contact; for minors, at least five years after they turn 18.
