Can you run an Indiana personal services agency from home?

IDOH’s instruction letter says an Indiana personal services agency may use a home or residential address, as long as it has a physical location in Indiana. Here is what IDOH asks about your office, how long records stay there, how branch offices work, what to do when you move, and what the state sources leave to your city or county.

Quick answer

Yes, according to IDOH. Its instruction letter for initial applicants says "The personal services agency must have a physical location within the State of Indiana." and "The provider may utilize a home or residential address for the personal services agency." IDOH instruction letter (last updated August 2022), page 3 IDOH’s application form adds that you need a physical location and an operational agency phone. State Form 53391, Section II.A The statute, IC 16-27-4, does not say what kind of premises the office must be, though it assumes an office in Indiana, where records are kept. IC 16-27-4-18

The letter dates from the paper application process, and IDOH’s current program page does not link it (in the copy we saved on October 1, 2026). We found nothing newer from IDOH on home offices. Wherever the office is, records must be kept there, or be electronically accessible there, for at least seven years, and IDOH reads the statute as giving you 24 hours to produce documents it asks for. IC 16-27-4-18 IDOH-HCBC/PSA-1

What IDOH asks about your office

The statute says little about the office itself. Most of what follows comes from IDOH’s application form, its 2022 instruction letter and its program page, so each card says which.

A physical location in Indiana

IDOH’s instruction letter for initial applicants puts the office in Indiana. The statute points the same way: records are kept at the agency’s office in Indiana (IC 16-27-4-18), and an agency based in another state needs Secretary of State authorization and a branch office in Indiana (IC 16-27-4-6(c)).

A home address is allowed

The same letter, in the same paragraph, says the location may be a home or residential address. The statute does not say what kind of premises the office must be.

A working agency phone

The application form asks for the parent practice location’s street address and an agency-specific phone number, fax number and email address.

Office hours you set

The form asks for office hours for each day of the week, and the Gateway makes agency hours a mandatory field. Neither sets a minimum.

A 24-hour phone for clients

Whatever your office hours, the manager or a designee answers client calls around the clock, and the client rights statement says how to reach them when the office is open or closed.

A separate mailing address if you want one

The application has a mailing address section, with a P.O. Box field, for an address that differs from the practice location. The renewal form says IDOH writes to that address.

The client rights statement, given to each client within seven days after services start, must include "The hours the personal services agency's office is open for business" and how to reach the manager or a designee while the office is open or closed.   1. Check that IDOH still accepts a home address

    Before you apply

    The home address line is in IDOH’s instruction letter, last updated in August 2022, from before the Gateway. IDOH’s current program page does not link that letter, and we found nothing newer from IDOH on home offices. Asking PSA@health.IN.gov before you apply is our suggestion.

  2. Check zoning, your lease and any HOA rules

    Before you apply

    The state sources we hold say nothing about zoning, home occupation permits or local business licenses. Ask your city or county planning or zoning office whether a business office is allowed at your address, and check your lease or homeowners association rules (our suggestion).

  3. Decide which address goes where

    The practice location is the physical address on your application, and IDOH’s public directory shows each agency’s street address (IDOH directory). If the office is your home, that is your home address. A different mailing address, such as a P.O. Box, can go in the form’s mailing address section, and IDOH’s correspondence goes there (Form 53591).

  4. Set your office hours and the 24-hour phone

    Before you apply

    Pick hours you can keep: they go on the application and in the Gateway, and the client rights statement must give them (IC 16-27-4-12(8)). Plan who answers client calls when you are out on visits or the office is closed: the manager or a designee named in writing (IC 16-27-4-9(b)).

  5. Give records a secure place

    Records, or copies, must be kept at the agency’s Indiana office or be electronically accessible there for at least seven years. In a family home, a lockable cabinet used only for the agency, and passwords on electronic records, are a simple way to keep them apart and private (our suggestion; the statute does not name a method).

  6. Be ready to produce documents within 24 hours

    From your first client

    IDOH may inspect on site when it issues or renews a license (IC 16-27-4-6(e)), and investigates complaints (IC 16-27-4-12(12)). IDOH’s 2024 requirements document says a PSA has 24 hours to produce documents it requests during an investigation; the statute’s own wording is "not less than twenty-four (24) hours" (IC 16-27-4-6(g)). Keep records where whoever is on duty can find them.

Records: where they live and for how long

One section of the statute covers where records are kept: "The documentation or copies of the documentation must be maintained or be electronically accessible at a personal services agency's office in Indiana for not less than seven (7) years." In the CareRulebook manual, Policy 1.5 Compliance documentation sets the time frame, place and method IDOH asks for, and counts the seven years from the latest date that applies (our reading, since the statute is silent). Policy 2.7 Client records and staff files sets out what goes in each client record and staff file.

Branch offices and your service area

"Each parent personal services agency must obtain a separate license." A branch operates under the parent’s license, and the parent is "the personal services agency that develops and maintains administrative and fiscal control over a branch office". IC 16-27-4-6(a) IC 16-27-4-2

What a branch must be

A site the agency provides services from, owned and controlled by the parent, and "located within a radius of one hundred twenty (120) miles of the parent personal services agency".

What IDOH asks

A letter and a map

IDOH’s 2022 letter asks for a separate letter (branch name, complete address, county, phone, a statement that it is owned and controlled by the parent, and that it is within 120 miles) with a map showing the 120-mile radius and the mileage. The letter adds that the branch must be a location or site from which the agency provides services. Its 2024 document asks for the full address and a map, sent by a manager, owner or other designated party on file.

Before it opens

Approval first

IDOH’s renewal form says "Branch additions and relocations require additional information for review and approval prior to being added to a license." It lists only branches IDOH has already approved.

How to send it now. IDOH’s program page as archived on May 18, 2026, in the section it said applied until May 1, 2026, said provider changes went by email to PSA@health.in.gov, and that adding a location needed a Google map that "Must clearly document the distance between the parent address and the new branch address". IDOH program page, archived May 18, 2026 Since May 1, 2026 the Gateway application and renewal each have a location step: "If the agency has multiple locations, click Add Location button to add additional locations." IDOH program page, archived May 18, 2026 IDOH program page The current page does not say how to add a branch between renewals, so ask PSA@health.IN.gov before you sign a lease for one.

A home health branch is measured differently: within 120 minutes’ driving time of the parent, not a 120-mile radius. 410 IAC 17-9-5 The home health vs home care page compares the two licenses.

Your service area. We found no service area or county list for the PSA license: IC 16-27-4, the application and renewal forms and IDOH’s 2024 requirements document ask for addresses (some with their county), not a list of counties you serve, and the 120-mile radius applies only to branches (our reading of those sources). Two other routes do work by area. The home health program lists a "Geographic Area Served" form, and a home health agency may serve any county in Indiana. Moving, renaming or changing your office

IDOH’s 2024 requirements document lists what to send for each change. Its renewal form says stock transfers, changes of ownership, branch additions or address changes and name changes "will not be processed with the renewal application", and asks for them as they occur. State Form 53591

IDOH asks for the license number, the new physical or mailing address and the date of the change, sent by a manager, owner or designated party on file. Its documents give no deadline and do not say whether the report goes before or after the move.

Changing hours, phone, fax or email

The same IDOH document lists phone, fax, email and office hours changes, each with the date of the change. Update your client rights statement too, since it gives your office hours.

Changing the agency’s name

IDOH asks for the new name with the Secretary of State certificate (assumed business name or amendment), and does not process name changes with a renewal.

Adding or moving a branch

IDOH reviews and approves a branch addition or relocation before it goes on the license, using the same letter and map either way.

Closing a branch

To close a branch, IDOH asks for the agency name, license number and effective date of closure, sent by a manager, owner or other designated party on file with IDOH. IDOH’s documents set no notice period for a branch.

Closing or selling the agency

Written notice to IDOH at least 30 days before. The license cannot be transferred, so a buyer gets its own license before operating.

How changes are sent. IDOH’s program page as archived on May 18, 2026 said provider changes must be emailed to PSA@health.in.gov with the agency name, license number, a description of the change, its effective date and any documentation that confirms it. That was in the section the page said applied until May 1, 2026. If you have branches, moving the parent office moves the point the 120-mile radius is measured from, so check each branch against the new address before you move (our reading of IC 16-27-4-6(b)).

What the state sources do not cover

We read IC 16-27-4, State Forms 53391 and 53591, IDOH’s 2022 instruction letter, its 2024 requirements document (IDOH-HCBC/PSA-1) and its PSA program page, current and as archived in May 2026. They do not address:

  • zoning, home occupation permits, local business licenses or signs;
  • a minimum office size, a separate entrance or a meeting room;
  • what counts as a "physical location", for example whether a virtual office or shared workspace does;
  • minimum office hours;
  • office insurance (the only insurance the statute names is liability insurance covering lift services, for agencies that provide them).

Myths about Indiana PSA offices

Can I run an Indiana PSA from my home?

It depends. As far as the state goes, yes: IDOH's 2022 instruction letter says the agency needs a physical location in Indiana and may use a home or residential address, and IDOH's form asks for an operational agency phone. The statute does not say what kind of premises the office must be, though IC 16-27-4-18 expects an office in Indiana where records are kept. The state sources we checked say nothing about zoning or home business permits, so check with your city or county. Records must be kept, or be electronically accessible, at the Indiana office for 7 years.

Does each office of an Indiana PSA need its own license?

It depends. A branch office does not: it operates under the parent’s license if it is a site the agency provides services from, owned and controlled by the parent, and within a 120-mile radius of it. Each parent agency needs its own license, and IDOH asks for the branch address and a map before a branch is added.

Must an Indiana PSA keep paper records at its office?

No. The statute requires the documentation, or copies of it, to be kept at the agency’s Indiana office or be electronically accessible there, for at least seven years. Paper files at the office are one way to meet it; electronic records that can be opened at the office are another.

Frequently asked questions

Can I run an Indiana personal services agency from my house?

IDOH says you can. Its instruction letter for initial applicants (last updated August 2022) says the agency must have a physical location in Indiana and that the provider may use a home or residential address. The application form also asks for an operational agency phone. The statute does not say what kind of premises the office must be, though it expects an office in Indiana where records are kept. Because the letter predates the Gateway and is not linked from IDOH’s current program page, our suggestion is to confirm with PSA@health.IN.gov before you apply, and to check local zoning with your city or county.

Can I use a P.O. box or a virtual office address?

A P.O. box can be your mailing address: the application has a mailing address section with a P.O. Box field, and IDOH sends correspondence there. The practice location is different: the form says the applicant must have a physical location, and IDOH’s letter says it must be in Indiana. Neither defines "physical location" or says whether a virtual office or shared workspace counts, so ask IDOH before relying on one.

Will IDOH inspect my home office?

It may. The statute lets IDOH conduct an onsite inspection when it issues or renews a license, limited to checking compliance with IC 16-27-4, and IDOH investigates complaints. The client rights statement must also tell clients that IDOH does not inspect PSAs as part of the licensing process. We found nothing from IDOH saying how often it inspects. IDOH’s complaint page, which describes its complaint program in general, says facilities do not get advance warning of complaint investigations.

Can I keep my Indiana PSA records electronically?

Yes. IC 16-27-4-18 requires the documentation, or copies, to be kept at the agency’s office in Indiana or to be electronically accessible there, for at least seven years. The statute does not name systems or security standards. Whoever is on duty should be able to open them, since IDOH reads the statute as giving you 24 hours to produce documents it asks for.

How far from my office can an Indiana branch be?

Within a radius of 120 miles of the parent agency, and the branch must be a site the agency provides services from, owned and controlled by the parent. IDOH asks for the branch’s address and a map showing the mileage before it adds the branch. (A home health agency’s branch is measured differently: within 120 minutes’ driving time.)

Do I have to tell IDOH which counties my PSA serves?

We found no such requirement for the PSA license: IC 16-27-4, the application and renewal forms and IDOH’s 2024 requirements document ask for addresses (some with their county), not a list of counties you serve, and the 120-mile radius applies to branch offices. Medicaid waiver work is different: OMPP certifies providers for specific counties, and the 2026 moratorium stops existing waiver agencies adding counties for the services it covers, unless the IHCP grants an exception.

What do I do if I move my Indiana PSA office?

Tell IDOH: its 2024 requirements document asks for the license number, the new address and the date of the change, sent by a manager, owner or designated party on file. IDOH’s documents give no deadline, and the current program page does not say how changes are sent now that applications go through the Gateway, so ask PSA@health.IN.gov. If you have branches, check that each is still within 120 miles of the new address (our reading, since the radius is measured from the parent).

Do I need a local business license or zoning approval?

The Indiana sources we hold for PSAs (IC 16-27-4, IDOH’s forms, letter, requirements document and program page) do not address zoning, home occupation permits or local business licenses. That does not mean your city or county has no rules, so ask them, because the answer depends on where you are.
