Quick answer
A Texas home care agency licensed for personal assistance services (PAS) needs the written policies required throughout 26 TAC Chapter 558. HHSC does not publish a list, so you have to find them in the rules. We count 48 requirements for written policies, plans and records that apply to a PAS agency, including operating hours, staffing, background checks, abuse reporting, complaints, emergency preparedness, infection control, client rights, the individualized service plan, supervision, QAPI and records retention.
HHSC checks them at your initial survey, where all required policies must be ready for review. Anything your policy promises beyond the rule, you must also do.
Why there is no official list
HHSC’s FAQ answers the question directly: "HHSC does not maintain a list of policies required for HCSSA agencies." Chapter 558 is the list, spread across dozens of sections. Some say "adopt and enforce a written policy", some say "written plan" or "written procedures", and some sit inside the PAS-specific rules in §558.404.
That is why so many new agencies buy generic manuals, and why the manuals often miss Texas-specific requirements. The table below is our answer: every requirement, quoted, with the policy that covers it.

Some requirements apply only if your agency does that activity. Leave them out if they do not apply, and add them before you start:

Write the minimum the rule requires, then do it
A policy is a promise the surveyor will hold you to. HHSC’s FAQ uses driver’s license copies as the example: the personnel record rule does not require them, "However, if the agency’s policy states that a copy of the driver’s license will be included in the personnel record, the agency must follow its policy".
So a good manual says what the rule requires, clearly, and no more unless you choose to. Every extra commitment in a template, such as more frequent supervisory visits or extra training hours, becomes something you can be cited for if you do not do it.
What surveyors check
At the initial survey the rules require four things to be ready: a client list, client records, all agency policies required by Chapter 558, and all personnel records. The most-cited home health violations in FY 2025 show where agencies slip between writing a policy and following it:
- failing to let a surveyor in within two hours when the office is closed (the most cited, 146 times);
- missing the annual nurse aide and misconduct registry recheck (second, 101 times);
- administrator continuing education not completed (fifth, 80 times); and
- PAS individualized service plans missing required elements (ninth).

Frequently asked questions
Does HHSC give you a list of required policies?
No. HHSC’s FAQ says it "does not maintain a list of policies required for HCSSA agencies". The requirements are in 26 TAC Chapter 558, section by section.
How many policies does a Texas PAS agency need?
It depends on how you group them. We map 48 requirements in Chapter 558 for written policies, plans and records that apply to a PAS agency onto 35 policies in 11 manual sections. Some apply only if your agency does that activity, such as using volunteers or contractors.
When does HHSC check my policies?
At the initial survey. The rules require all agency policies required by Chapter 558 to be available and ready for review when the surveyor arrives, along with client and personnel records.
Can I use a generic policy manual from another state?
You can start from one, but each Texas rule has specific wording, for example on abuse reporting, background registries and the individualized service plan. A manual that does not map to Chapter 558 risks missing requirements, and anything it promises beyond the rules you must still do.
What happens if my policy says more than the rule requires?
HHSC expects you to follow your own policy. Its FAQ gives the example of driver’s license copies: not required by the rule, but required if your policy says you will keep them.
Which policies will the proposed 2026 rules change?
Mainly abuse, neglect and exploitation reporting (one hour instead of 24), background checks (SEMARC), infection control (an infection control officer), client care (no telehealth for PAS-only agencies) and workplace violence. None of this is in force yet.
How long must records be kept?
Original client records must be kept for at least five years after the client is discharged, under a written retention policy (26 TAC §558.301(b)).
