To start a non-medical home care agency in Texas you need an HCSSA license in the Personal Assistance Services category from HHSC. It costs $2,625 for three years, and HHSC checks your written policies at the initial survey, which you must request within six months of licensing.

  1. Confirm you need a PAS license

    If staff will help with any personal care task, you need an HCSSA license in the Personal Assistance Services category. Companion, chore or household services alone are exempt.

The HCSSA license fee is charged per license, not per category. A parent agency, a branch office and a change of ownership each cost $2,625, and the three-year renewal costs the same. HHSC does not review an application until the portal shows payment received, and fees are not refundable.

Late renewals cost half the renewal fee on top. Reporting a change such as a new administrator, address or name costs $30, and reporting it late adds a $100 late fee on top. The rules cap HHSC’s processing at 45 days to confirm your application is complete and 45 days to issue the license, but HHSC publishes no average approval time, so plan for training and office setup before you apply.

Can you run a Texas home care agency from home?

Yes. (Full guide to running a Texas agency from home.) HHSC’s FAQ says: "You can use your home address as the HCSSA address if this will be the place of business from which home health, hospice, or PAS is directed." The one exception is a hospice inpatient unit.

Three conditions come with it. It must be a permanent physical place, because HHSC does not allow virtual offices. Your original active client records must be stored there. And if a surveyor arrives during business hours and you are closed, someone you have designated in writing must let them in within two hours. That last rule was the single most-cited home health licensing violation in Texas in FY 2025, with 146 citations.

Administrator requirements and training

Every Texas HCSSA has exactly one administrator and one alternate administrator. For an agency licensed only for personal assistance services, each needs one of: a high school diploma or GED plus at least one year of experience or training caring for people with functional disabilities; two years of full-time study in a health-related field at an accredited college; or the qualifications required of a home health administrator. Neither needs a professional license.

Training comes in three parts:

  • HHSC Presurvey Training, a computer-based course both must finish before you submit the application.
  • 24 hours of administration training. Eight hours must be done in the 12 months before designation, and the other 16 within the first 12 months after. The Presurvey Training does not count toward these hours.
  • 12 hours of continuing education in every 12-month period after designation. Missing it was the fifth most-cited home health violation in FY 2025.

Your initial survey

HHSC does not schedule your first inspection on its own. Within six months of the license date, you must admit and serve at least one client and send a written request for the initial survey on HHSC Form 2020, Notification of Readiness for Initial Survey. If you miss it, HHSC may refuse to renew the initial license, or revoke or suspend it.

When the surveyor arrives, the rules require four things to be ready for review:

  1. a list of clients;
  2. the client records for each client admitted before the survey;
  3. all agency policies required by Chapter 558; and
  4. all personnel records.

The ten most-cited home health violations in FY 2025 were mostly documentation: survey entry, annual registry rechecks, late abuse reports, the QAPI program and meetings, administrator continuing education, personnel records, and PAS individualized service plans missing required elements.

Background checks and registries

Before hiring unlicensed staff with client contact, run a criminal history check and search the registries. Since August 3, 2026, HHSC requires a search of SEMARC (the Search Engine for Multi-Agency Reportable Conduct) as well as the Nurse Aide Registry. SEMARC replaces the separate Employee Misconduct Registry check. Repeat the registry searches at least every 12 months: missing the annual recheck was the second most-cited violation in FY 2025.

HHSC starts surveying for SEMARC compliance on October 6, 2026. Keep a copy of each search result in the personnel file.

Rule changes coming to Chapter 558

On September 18, 2026, HHSC proposed rewriting Chapter 558. For PAS agencies the biggest changes are abuse reports within one hour, SEMARC in the rule text, no virtual offices, no nursing or telehealth for PAS-only agencies, and a six-month survey deadline that runs without a payer contract. None of it is in force yet.

Can I run a Texas home care agency from my home address?

YesHHSC allows a home address as the HCSSA place of business, as long as services are directed from there. It must be a real physical place, active client records must be kept there, and someone must let a surveyor in within two hours during business hours.

Can I use a virtual office or mailbox address?

NoHHSC says the place of business must be a permanent physical place. The proposed 2026 rules would put the ban into the rule text.

Do companion or sitter services need a Texas license?

It dependsNot if they are truly companion, chore or household services only. As soon as staff help with personal care, including assisting with self-administered medication, you need the PAS license.

"a person or organization providing sitter-companion services or chore or household services that do not involve personal care, health, or health-related services;"

Does the administrator of a PAS agency need to be a nurse?

NoA high school diploma or GED plus one year of experience or training caring for people with functional disabilities qualifies.

"For agencies that provide PAS only, the administrator and alternate administrator do not have to be licensed but have to meet the qualifications in 26 TAC §558.244 (a)(3)."

Frequently asked questions

How long does it take to get a Texas HCSSA license?

The rules allow HHSC up to 45 days to confirm the application is complete and up to 45 more days to issue the license. HHSC does not publish average real-world approval times. Add the time for training and setting up your office before you apply.

Can I take clients while my application is pending?

No. An applicant must not admit a client or start services until the application process is complete and the initial license is issued (26 TAC §558.11(a)).

Does the administrator of a PAS agency need to be a nurse?

No. For a PAS-only agency, a high school diploma or GED with at least one year of experience or training caring for people with functional disabilities qualifies (26 TAC §558.244(a)(3)).

Can I use a virtual office?

No. HHSC says an agency cannot have a virtual office as its place of business; it must be a permanent physical place. A home address is allowed.

What happens if I miss the six-month survey deadline?

HHSC may deny renewal of the initial license or revoke or suspend it, and an initial license cannot be renewed without an initial survey unless the agency is accredited (26 TAC §558.15(c), §558.19(b)).

Where do I report abuse, neglect or exploitation?

To HHSC Complaint and Incident Intake, not DFPS, since September 1, 2023. The rule in force requires reporting within 24 hours. HHSC has proposed cutting that to one hour.

Which registries must I check before hiring?

Since August 3, 2026, HHSC requires a SEMARC search plus the Nurse Aide Registry, repeated every 12 months. HHSC surveys for SEMARC compliance from October 6, 2026 (PL 2026-10).

Do employees need TB tests?

Not as a licensing requirement. HHSC’s FAQ says there is no regulatory requirement for an HCSSA to conduct employee TB screenings.

Can attendants fill weekly pill organizers?

Not for clients who self-administer. HHSC’s FAQ says filling weekly pill minders for these clients is not an authorized PAS service.

How often is a Texas agency surveyed after the initial survey?

HHSC may survey within 18 months after the initial survey and must conduct an on-site survey at least every 36 months after that.
