Tennessee PSSA policies and procedures: the 17 items and 8 topics

Tennessee lists the written policies a personal support services agency needs: 17 items in Rule 0940-05-38-.06(1) and 8 personnel-policy topics in .07(2). TDMHSAS reads policies at its electronic desk audit before the first license, and says it should only cite the policies the rules require. Here is each item, the documents other rules add, TDMHSAS’s common deficiencies, all 107 requirements mapped to a policy, and where the rules are silent.

Quick answer

Tennessee’s rules list the policies. "The licensee shall ensure that the agency is administered and operated in accordance with written policies and procedures including, but not limited to, those specified in Rule 0940-05-38-.06." (0940-05-38-.05(2)). Rule .06(1) gives 17 policy items, (a) to (q), and rule .07(2) requires written personnel policies on 8 topics, (a) to (h) (0940-05-38-.07(2)). Other rules add written documents, such as the consumer notice and the worker notice. In all we mapped 107 requirements.

You do not send policies with the four application forms, but the first inspection for a PSSA is an electronic desk audit, and TDMHSAS says initial inspections cover "certain policies and procedures" (TDMHSAS). Deficiencies must be corrected before a license is issued (0940-05-02-.06(5)(b)).

TDMHSAS also says an agency "should only be cited for violation of policy rules that are listed in the applicable administrative rules for the agency." (PSSA slides, slide 38). It does not publish which policies its desk audit reads, so by our reading the safe plan is all of them, written and adopted before you apply.

What TDMHSAS reads, and when

Before the first license: the desk audit. TDMHSAS’s process page says "Initial inspections for Personal Support Services Agencies (PSSAs), D.U.I. Schools, and Non-Residential Office-Based Opiate Treatment offices (OBOTs) are conducted via an electronic desk audit." (Become a Licensed Provider, step 5). On what an initial inspection covers: "Generally (with a few exceptions), life safety and environment/ancillary services are inspected as well as certain policies and procedures." A PSSA needs no life safety or fire inspection (step 4), so by our reading the weight of a PSSA desk audit falls on the policies and procedures. TDMHSAS does not say which ones; it says a Regional Manager can explain the next steps (step 5).

Deficiencies come first. "If the review indicates deficiencies, the applicant will be notified and must correct deficiencies before a license is issued" (0940-05-02-.06(5)(b)). Then TDMHSAS issues an initial license for up to one year (step 6).

Proposed: the rule would say so. TDMHSAS’s proposed rewrite of 0940-05-02 (hearing November 18, 2026; not in force) says that before an initial license TDMHSAS "may review policies, procedures, personnel files, service recipient records, attestations, accreditation, certification, virtual review materials, or other documentation sufficient to determine compliance" (proposed 0940-05-02-.06(5)). By our reading that matches what the desk audit already does.

After licensing. "The Department shall make at least one (1) unannounced inspection of each licensed facility/service yearly." (0940-05-02-.22) Its staff may enter, talk to clients and review and copy the records needed to check compliance, with or without notice (0940-05-02-.13). How TDMHSAS inspects a PSSA.

After an incident. Your policies are read again when you report an incident. TDMHSAS’s reporting guidance asks for:

  • An accident: the needs assessment and plan of care, the equipment training the caregiver received if it happened during a transfer, and "Provide a copy of any related policies and disciplinary actions" (PSSA slides, slide 41).
  • A missed visit: "Provide a copy of the back-up staffing policy and the alternate plan for staffing service recipient" (PSSA Reporting Documentation).
  • A theft: "Provide a copy of the policy related to the receipt and disbursement of money on behalf of the client", with the written accounts and receipts (PSSA slides, slide 43).
  • A reportable death: "Provide a copy of the medical emergency policy" (PSSA slides, slide 42).

By our reading, that is why each policy should describe what your agency actually does: the policy you send after an incident is measured against what happened.

The rule begins "The licensee shall maintain written policies and procedures that include the following:" (0940-05-38-.06(1)). The last column is the policy that meets each item in the CareRulebook manual’s desk-audit crosswalk. Items marked Common deficiency are on TDMHSAS’s own list (PSSA slides 12-16). 3 items apply only if you do the activity.

The manual states all eight in one place, Policy 4.1, in the rule’s order, because the rule asks for written personnel policies that address them; the procedure for each lives in the policy named.

One more ban to put in the personnel policies. Rule 0940-05-06-.03(2), which applies to PSSAs, says "The licensee shall prohibit staff, volunteers and proprietors from soliciting or borrowing money or property from service recipients." (0940-05-06-.03(2)). It reaches owners and volunteers as well as workers, so the manual repeats it in Policy 4.1 and Policy 2.8.

Written documents beyond the two lists

The record, personnel and licensing rules ask for documents that are not on either list. Several are on TDMHSAS’s common deficiency list, so a manual that stops at the 17 items and 8 topics leaves gaps. Each row quotes the rule in the full crosswalk below.

TDMHSAS’s common PSSA deficiencies

TDMHSAS’s PSSA Provider Information slides list eleven common rule deficiencies (PSSA slides 12-16). By our count only 3 are policy items; the rest are client records, personnel files and training records. That is why the manual pairs each policy with the form that proves it was followed.

Requirements that depend on what you do

Where the rules are silent, and how the manual handles it

A policy still has to say what your agency does where the rules leave it open. In each of these places the CareRulebook manual sets out a process and labels it as your agency’s own choice or reading, so you know what you are free to change and what a TDMHSAS answer could change.

Which policies the desk audit reads

TDMHSAS says an initial inspection covers "certain policies and procedures" and that a Regional Manager can explain the next steps. We found no published desk audit checklist or list of the policies it reviews.

In the manual: Policy 1.5 sends the whole manual as adopted, with the blank forms and the desk-audit crosswalk from Policy 1.2, and has the person responsible ask the surveyor at first contact which items they want, in what format and by when.

How often policies are reviewed

The rules ask the licensee to run the agency under written policies and to establish them, but set no review cycle for PSSA policies.

In the manual: Policy 1.2 revises the manual when the rules change or TDMHSAS says otherwise. If you include Recommended practice, it also reviews the whole manual at least once a year on a date you choose, labelled as not a TDMHSAS requirement.

How the client mix is counted

The licensing department turns on whether 50% or more of clients are aged or have a mental illness or substance abuse diagnosis, and .06(1)(o) asks for a policy on categorizing the majority (over 50%) of the client base. The rules do not say how to count, and do not define "aged".

In the manual: Policy 1.3 counts active clients by head count, before accepting each new client and at least monthly, with early-warning thresholds the agency sets itself, and has the person responsible contact TDMHSAS before accepting a client who could tip the mix.

Notice before ending services

Item (a) asks for termination criteria, but no rule sets a notice period for ending services.

In the manual: Policy 2.1 gives written notice of the number of days you choose in the builder, and says the period is the agency’s choice because the rules set none.

What a needs assessment covers

Every client record needs a written service plan based on a needs assessment, stating the type, frequency, duration and amount of services. The rule does not say what the assessment covers or how often the plan is reviewed.

In the manual: Policy 2.2 has an assessment form covering each major life activity, safety in the home and the times help matters most, and rewrites the plan before any change in services. With Recommended practice, the plan is also reviewed at each six-monthly client evaluation.

A complaint sign for an agency that works in clients’ homes

The rule asks for a sign "in the facility or service" with TDMHSAS’s regional toll-free number. TDMHSAS publishes one statewide complaint line, 866-797-9470. How a home-based agency shows the sign to clients is not spelled out.

In the manual: Policy 1.4 posts the sign next to the license with the complaint line and the regional office’s number, and Policy 2.5 prints the same numbers in the rights statement every client receives. Both say this is the agency’s reading.

Errand money and the no-receiving rule

Workers may "neither borrow, receive nor take" client funds, yet household assistance includes shopping and bill paying, and item (j) expects money to be received and spent on clients’ behalf.

In the manual: Policy 2.8 reads the ban as covering money or property a worker receives for themselves: errand money is received for the client, kept apart and accounted for in full. Gifts, however small, are politely declined. The policy says both are the agency’s reading.

Training hours and pass marks

Workers show basic competency in seven areas before work and get job-related training at least yearly. No rule sets a number of hours, a pass mark or a format for showing competency.

In the manual: Policy 4.6 sets its own pass standard and forms, sets no hour minimum, and counts the training year the way you choose, saying each is the agency’s own.

When the 10 years of records start

TDMHSAS says records are kept 10 years, quoting the statute’s "after termination of service". The PSSA rules set no period themselves, and neither source says which date starts the clock.

In the manual: Policy 5.2 counts the 10 years from the last day of service, and keeps personnel files for at least a year after a worker leaves (10 years if you include Recommended practice), each labelled as the agency’s reading or choice.

Reading the rules and TDMHSAS’s material closely, we found places where an older rule says something different, where TDMHSAS has said it will not enforce part of a rule, or where the official text has a slip. These are differences between the documents as we read them, and the ones without a TDMHSAS statement are on our list of questions for TDMHSAS.

The Medication Safety Policy

Medication assistance, item (l), is reminders and opening packaging (0940-05-38-.01(9)). Since Public Chapter 730 of 2024, an unlicensed PSSA employee may administer medication in the client’s home to a client who cannot self-administer, after a competency-based training program TDMHSAS approves (Public Chapter 730 (2024)). TDMHSAS has approved DDA’s classes (PSSA slides, slide 21).

No rule yet requires a policy for this. TDMHSAS says agencies using certified staff should notify their surveyor, keep each certificate in the personnel file, and "Develop and implement a Medication Safety Policy" (PSSA slides, slide 22). It offers DDA’s sample: "The sample policy is a standardized medication administration policy consistent with the program rules." It says it intends to make PSSA rules that will mostly require medication administration policies and procedures, and that these rules "but are not necessary on the front end of caregiver ability to receive this certification" (slide 22). None had been filed as of October 2, 2026 (Secretary of State, pending rules).

In the manual: Policy 2.12 is included only if you choose medication administration in the builder, and opens with a note on its status: TDMHSAS asks for a Medication Safety Policy, but no rule requires one yet. DDA’s sample is written for DDA providers; by our reading parts of it need adapting to care in clients’ own homes, and the open points are on our list of questions for TDMHSAS.

    Manuals written for home health agencies describe nursing, vital signs and medication administration. TDMHSAS lists blood pressure checks, filling medication planners and applying ointments of any kind among the tasks a PSSA may not do. PSSA slides 25-27

    Does it cover the common deficiencies by name?

    Eight of TDMHSAS’s eleven common deficiencies are records and training, not policies. A good manual gives you the forms: the medication authorization, the consumer notice, the evaluation form, the rights acknowledgement and the competency checklist. PSSA slides 12-16

    Does the back-up plan keep coverage off the client?

Does TDMHSAS publish a list of the policies it reviews at the PSSA desk audit?

No. Not that we found. TDMHSAS says an initial inspection generally covers life safety and environment/ancillary services as well as "certain policies and procedures", and that a Regional Manager can explain the next steps. It does not name the policies. The rules themselves list 17 policy items in 0940-05-38-.06(1) and 8 personnel-policy topics in .07(2). Our suggestion: have all of them written and adopted before you apply, and ask the Regional Manager what the desk audit will look at.

"Generally (with a few exceptions), life safety and environment/ancillary services are inspected as well as certain policies and procedures."

Are the 17 items in 0940-05-38-.06(1) the only written policies a Tennessee PSSA needs?

No. Rule .07(2) separately requires written personnel policies on eight topics, from workers being 18 or older to the ban on borrowing or taking client money. Other rules need written documents too: a consumer notice and a rights acknowledgement in every client record, a worker notice in every personnel file, and an evaluation form each client signs at least every six months.

Can TDMHSAS cite my agency for missing a policy the rules don’t require?

No. TDMHSAS says it should not: an agency should only be cited for policy rules listed in its applicable administrative rules. For a PSSA that means the 17 items in 0940-05-38-.06(1), the eight personnel-policy topics in .07(2), and the other written duties in 0940-05-38, 0940-05-02 and 0940-05-06-.03(1)-(6).

Can I adopt DDA’s sample Medication Safety Policy as it stands?

It depends. TDMHSAS asks a PSSA whose staff will administer medication to develop and implement a Medication Safety Policy, and offers DDA’s sample, which it calls a standardized medication administration policy consistent with the program rules. The sample is written for DDA providers, so by our reading parts of it need adapting to care in clients’ own homes. TDMHSAS has said PSSA medication rules are coming; none had been filed as of October 2, 2026.

Rule 0940-05-38-.06(1) lists 17 items, (a) to (q): a description of services with enrollment and termination criteria, an organizational chart, a worker absence plan, a fee schedule when you charge fees, client rights and grievances, confidentiality, emergency plans, abuse and incident reporting, communicable disease, client money, TDMHSAS access to workers, medication assistance and transportation if you offer them, lifts and gait belts, client-mix categorization, cooperation with investigations, and an alternate staffing plan. Rule .07(2) adds written personnel policies on eight topics, (a) to (h).

Do I send my policies to TDMHSAS with the application?

TDMHSAS lists four forms for the application, and policies are not among them. But the initial inspection for a PSSA is an electronic desk audit, which TDMHSAS says covers certain policies and procedures, and any deficiencies must be corrected before a license is issued. By our reading you need every required policy written and adopted when you apply. TDMHSAS does not publish which policies the desk audit reads; ask the Regional Manager.

Can TDMHSAS cite me for a policy the rules do not require?

TDMHSAS says it should not: an agency should only be cited for violating policy rules listed in the administrative rules that apply to it. For a PSSA those are 0940-05-02, 0940-05-38 and 0940-05-06-.03(1)-(6).

Which policies does TDMHSAS commonly find missing?

TDMHSAS’s list of common PSSA deficiencies names three policy items: the lift and gait belt policy (.06(1)(n)), the rights statement and grievance procedure (.06(1)(e)) and the policy of cooperating with investigations (.06(1)(p)). The other eight items on its list are records and training: medication assistance authorizations, consumer notices, six-monthly client evaluations, rights acknowledgements, emergency contacts, RN-supervised medication assistance training, annual performance evaluations and competency before work.

Do I need a lift and gait belt policy if I never use a Hoyer lift?

Item (n) is not written as conditional: the rule says the licensee shall maintain policies to address use of devices such as a Hoyer lift or gait belt, after training, for transfers but not as therapy, and TDMHSAS lists it among common deficiencies. By our reading every PSSA needs it. The CareRulebook manual includes it for every agency, with a version for agencies that do not use lift devices.

How often do Tennessee PSSA policies need reviewing?

The rules set no review cycle. The licensee must run the agency under its written policies and establish the policies that govern it, so a policy should be revised whenever the rules or your practice change. The CareRulebook manual offers a yearly review as Recommended practice, labelled as not a TDMHSAS requirement.

Do I need policies for services I do not offer?

Some duties apply only if you do the activity: 18 of the 107 requirements we mapped are conditional, such as medication assistance, transportation, fees, client money and legal representatives. The CareRulebook builder asks about each one. For medication assistance, medication administration and transportation, where you do not offer the service the manual includes a short statement saying so in place of the policy.
