Texas home care administrator requirements

Every Texas home care agency needs one administrator and one alternate. For a PAS agency neither needs a professional license, but both need the right experience or education, HHSC’s Presurvey Training, 24 hours of training in the first year and 12 hours every year after.

Quick answer

A Texas agency licensed only for personal assistance services (PAS) needs one administrator and one alternate administrator. Neither needs a professional license. Each must have a high school diploma or GED with at least one year of experience or training in caring for individuals with functional disabilities, or two years of health-related college study, or the qualifications for a home health administrator. Both must read, write and understand English.

Both complete HHSC’s Presurvey Training before the license application and 8 hours of administration training in the 12 months before they are designated. The rest of the 24 hours are due within 12 months after designation, then 12 hours of continuing education every year. Missing that continuing education was the fifth most-cited violation at Texas home health agency inspections in FY 2025, with 80 citations.

Who can be the administrator of a PAS agency

26 TAC §558.244(a)(3) gives three routes. The administrator and the alternate must each meet at least one:

Route 1

High school diploma or GED

Plus at least one year of experience or training in caring for people with functional disabilities.

The home health qualifications

A licensed physician, RN, social worker, therapist or nursing home administrator with a year of health-related management experience, or a diploma or GED with two years of it.

On top of that, both must meet the conditions in §558.244(b):

  • English. "An administrator and alternate administrator must be able to read, write, and comprehend English."
  • No recent enforcement history. Someone who was administrator of an agency when a violation led HHSC to revoke or suspend its license, deny a license application or obtain an injunction cannot be an administrator anywhere for 12 months after that action. Fines do not count: the rule excludes "administrative or civil penalties".
  • No barring convictions. Neither may have a conviction for an offense listed in 26 TAC Chapter 560 within that chapter’s time frames.

If you later add home health or hospice services, the bar rises: a licensed professional with a year of health-related management or supervisory experience, or a diploma or GED with two years of it (§558.244(a)(1)).

The training clock

These rules apply to anyone designated administrator or alternate for the first time since December 1, 2006, which covers almost every new administrator. The clock starts from the date of designation.

What the first 8 hours must cover

Information on the licensing standards for an agency, and on the state and federal laws that apply to one: Texas Health and Safety Code Chapters 142 and 250, Human Resources Code Chapter 102 (Rights of the Elderly), the Americans with Disabilities Act, the Civil Rights Act of 1991, the Rehabilitation Act, the Family and Medical Leave Act and OSHA requirements.

What the other 16 hours must cover

Fraud and abuse detection and prevention; legal issues around advance directives; client rights, including confidentiality; agency responsibilities; complaint investigation and resolution; emergency preparedness; abuse, neglect and exploitation; and infection control. They may include other topics related to the administrator’s duties.

What counts as training

Structured classes, correspondence courses, competency-based computer courses, training videos, distance learning or off-site courses. "Subject matter that deals with the internal affairs of an organization does not qualify for credit." The training can come from an academic institution, a recognized state or national organization or association, a consultant or an agency. If a consultant or an agency provides it, it must be approved by HHSC or recognized by a state or national organization or association, and you must keep proof of that for the surveyor.

HHSC publishes a list of providers of administrator training, with a caveat: "HHSC does not endorse these providers." Whoever you choose, it is up to you to check the course meets §558.259.

Continuing education: 12 hours every year

After the first-year 24 hours, the administrator and alternate each complete 12 clock hours of continuing education within each 12-month period. The hours must cover at least two of these topics:

  • any of the 16-hour subjects above
  • development and interpretation of agency policies
  • basic principles of management in a licensed health-related setting
  • ethics
  • quality improvement
  • risk assessment and management
  • financial management
  • skills for working with clients, families and other professionals
  • community resources
  • marketing

In FY 2025, HHSC cited home health agencies 80 times because "The agency’s administrator or alternate administrator failed to complete 12 hours of continuing education". The Presurvey Training does not count toward these hours either. See all ten most-cited violations →

Keep the training records at the agency

The surveyor will ask for proof. For the first-year 24 hours, the file must hold "the name of the class or workshop, the course content (such as the curriculum), the hours and dates of the training, and the name and contact information of the entity and trainer who provided the training." For continuing education it is the class name, topics covered, hours and dates. Both must be on file at the agency.

What the administrator is responsible for

Under 26 TAC §558.243(b)(1) the administrator is responsible for the agency’s administrative policies and operations and for supervising all services day to day. The rule lists ten duties:

  1. Amanage the daily operations of the agency
  2. Borganize and direct its ongoing functions
  3. Cadministratively supervise the quality of care
  4. Dmake sure policies and procedures are followed
  5. Emake sure service documentation is accurate and on time
  6. Femploy or contract with qualified staff
  7. Gmake sure staff education and evaluations are adequate
  8. Hkeep public information materials and activities accurate
  9. Irun an effective budgeting and accounting system that promotes clients’ health and safety
  10. Jreview client satisfaction survey reports for all clients

Around those duties the rules add a few specific obligations:

  • Be reachable. The administrator or alternate must be available to staff, in person or by phone, during operating hours.
  • Name who lets the surveyor in. The administrator designates in writing an employee who gives HHSC surveyors entry when the administrator and alternate are not available (§558.243(b)(3)).
  • Be at the survey. At the initial survey the administrator or alternate must attend the entrance and exit conferences in person (§558.523(a)).
  • Sign up for emergency alerts. Both must enroll in HHSC’s emergency communication system (§558.256(q)(1)), which HHSC’s FAQ names as AlertMedia.
  • Report changes. If the administrator or alternate changes, tell HHSC in writing no later than seven days after the change (§558.218(a)).

What the proposed 2026 rules change

  • §558.259(c)-(d)

    Still 8 hours plus the Presurvey Training before designation and 16 within 12 months. It now also covers anyone returning after a break of more than 12 months.

  • §558.243(a)-(b)

    The administrator and alternate are named in the online portal application, and the designation date is the date they sign the job description. The administrator must develop and carry out a plan of correction for cited deficiencies, and may be available by telecommunications.

  • §558.244(a)(3)(D)

    A PAS administrator and alternate must also have completed the Presurvey Training, or have proof of completing it in the 12 months before designation.

  • §558.259, preamble

    The first-year training would no longer have to be approved by HHSC or recognized by a state or national organization or association.

Frequently asked questions

What are the administrator qualifications for a Texas PAS agency?

The administrator and the alternate must each have a high school diploma or GED with at least one year of experience or training in caring for people with functional disabilities, or two years of full-time health-related college study, or the qualifications required for a home health agency administrator. They must also read, write and understand English.

Does a PAS administrator need a license?

No. HHSC’s FAQ says that for agencies providing PAS only, the administrator and alternate do not have to be licensed, but must meet the qualifications in 26 TAC §558.244(a)(3).

Can one person be both administrator and alternate?

No. Each licensed agency has exactly one administrator and one alternate administrator, and the license holder designates one person for each role. Multiple administrators are not allowed.

Can the owner be the administrator?

Chapter 558 does not require the administrator to be someone other than the owner. The license holder designates an individual who meets the qualifications and conditions in §558.244, so an owner who meets them can be designated.

How many hours of administrator training do I need before opening?

Eight clock hours, completed in the 12 months before you are designated, plus HHSC’s Presurvey Training before the application goes in. The other 16 hours of the 24 can be finished within 12 months after designation.

Does the HHSC Presurvey Training count toward the 24 hours?

No. The rules say it must not be applied toward the 24 hours of initial training or the 12 hours of continuing education.

How much continuing education does an administrator need each year?

Twelve clock hours in each 12-month period after the first year, covering at least two topics from the list in 26 TAC §558.260(a). Missing it was the fifth most-cited violation at Texas home health agency inspections in FY 2025, with 80 citations.

What if I change administrator?

Tell HHSC in writing no later than seven days after the change. The same applies to the alternate administrator, chief financial officer and controlling persons.
