Illinois home care policies and procedures: what Part 245 requires

In Illinois your policies are read twice: IDPH reviews them with the paper application (14 areas, as we group them), and IDPH’s surveyor checklist puts your policy and procedure manuals first among the materials a surveyor reviews. Quick answer

An Illinois home services agency needs written policies and procedures, adopted by its governing body, that ensure clients receive safe and adequate care (245.30(b)(1)). Part 245 and the background check rules in Part 955 name what several of them must cover, and we count 113 requirements in all.

Illinois reads your policies before it licenses you. Copies of your policies on complaints, employee health and safety, infection control, background checks and mandated reporting, supervisory visits, client records and training go in with the paper application, with your client contract, acceptance criteria and a sample service plan form. At the licensing survey IDPH inspects whether you meet the rules, and its surveyor checklist puts policy and procedure manuals first on the list of materials to review.

Many caregiver tasks, such as bathing and transfers, also need training and a competency check before the worker does them.

The policies IDPH reviews before it licenses you

Illinois asks for your policies up front, in the envelope with the paper application. The rule lists seven policy areas for the initial application, introduced with "Copies of policies and procedures for the following:" (245.90(a)(3)(I)), and also asks for the client contract, the criteria for accepting clients and a sample service plan form (245.90(a)(5), (7), (8)).

IDPH’s Home Services Application, form 445104, names nine policies (it splits supervisory visits into one for clients and one for workers, and adds client acceptance), and asks every applicant for a scope of services and a fee schedule (Form 445104, page 8). Grouped as policy areas, that is the 14 below. IDPH reviews the application within 30 days and emails you for revisions (IDPH FAQ).

The manager ensures legal compliance, keeps the rules on hand, completes required reports and records, liaises with the governing body and community, manages business affairs, keeps personnel and administrative records and all policies, hires to job descriptions and provides orientation and in-service education.

At least seven working days' notice with a reason before the agency ends services, recorded in the client record; when a worker's safety is at risk, notice may be shorter but the risk is documented.

Feeding help only when the client swallows independently and sits upright; high choking risk goes to a home health or home nursing agency. Pre-measured thickeners need training and a competency check.

Illinois does not leave caregiver tasks to your judgment. Part 245 lists home services tasks one by one, and for many of them the worker must be trained and the agency must have checked their competency first; a few also need a health care professional’s order (245.40(c)(4)). Your service plans can only include tasks inside that list (245.210(e)(4)).

Competency is checked twice during initial training as well: "The home services agency shall not give a worker an assignment until the worker has first passed a competency evaluation given by the agency of the topics included in the first five hours of training." The worker is tested again after the second five hours, and workers with prior training or CNAs on the registry still get your evaluation before their first assignment (245.71(c)).

  • Set up medications. Workers may only remind: ask, prompt, hand over or open a pre-filled, day-and-time-marked medication minder. Someone else (client, family, nurse or pharmacist) fills it. Irregularities are reported to the supervisor at once. (245.40(c)(4)(N))
  • Skilled care. Workers must not provide skilled personal care, act as a client's power of attorney, handle client finances outside the contracted services, or set up medications. (245.40(c)(5))

What IDPH surveyors ask for

IDPH inspects a new agency in the last 30 days of its 240-day provisional license (245.100(a)(3)). Its Surveillance Nurse Visit Checklist for home services says "the agency manager or a designee must be available for the survey when an IDPH nurse surveyor arrives", and that refusing a survey during business hours can bring a fine. The manager or designee must also be able to show the surveyor your access to the Health Care Worker Registry (955.115(a); 245.90(a)(3)(J)).

The rule is broad: "Agencies shall make available to the Department all books, records, policies and procedures, or any other materials requested during the course of an investigation or inspection." Refusing is grounds for revocation (245.110(c)). Surveyors may also visit clients at home, and IDPH gets the client’s consent before watching care being given (245.110(b)).

The checklist lists the materials a surveyor reviews. IDPH’s FAQ points agencies to it under the question "What information must I have ready/available for my agency's licensure renewal survey?" (IDPH FAQ), and IDPH publishes no separate list for the first survey, so treat it as the best guide to that one too. Some items, such as last year’s former clients, will be short or empty for a new agency. Here they are, with the policy in a CareRulebook manual that keeps each one:

IDPH’s guidance for common deficiency findings

IDPH also publishes guidance on what surveys commonly find. The registry finding it names is failing to run the six website verifications: "The new hire or rehire does not need another background check, HOWEVER, you are required to check the six registries in the web portal." (registry questions go to dph.hcwr@illinois.gov or 844-789-3676). It also sets out the initial and annual training requirements, including dementia training: "Staff with direct access to clients with Alzheimer’s disease or related dementia must complete minimally six hours of initial training in the first 60 days of employment with the dementia related topics listed below." (IDPH, Guidance for Common Deficiency Findings). Our suggestion: check those two areas twice before your survey: registry checks and verifications for every worker (Policy 3.5) and a complete training record for each (Policy 4.1).

After the survey

If IDPH issues a notice of violation, file a written plan of correction within 10 days, saying how and by when each violation will be fixed (245.120(b)). IDPH may fine up to $100 a day from the day a violation is identified until it is corrected (245.140). That is a state penalty, not a CareRulebook charge.

How to judge an Illinois policy manual before you buy

Whichever manual you use, including ours, check these 7 things first. IDPH reads it before you are licensed.

    Does it cover all 14 areas IDPH reviews with the application?

    Complaints, employee health and safety, infection control, background checks and mandated reporting, supervisory visits, client records and training, plus the contract, acceptance criteria and a sample service plan form. Ask for a policy-by-policy map. 245.90(a)(3)(I)

    Is it written for home services, not home health?

    A home services license allows no skilled services, and the service plan needs no physician signature. Manuals built around nursing assessments and physician orders will not match. Form 445104; 245.210(f)

    Does it have a competency check for each task?

    Bathing, transfers, positioning, compression devices, thickeners and oxygen switching all need training and a competency check first, and some need an order. 245.40(c)(4)

    Is medication help limited to reminding?

    Workers may remind from a container someone else filled, never set up medications, and report irregularities to the supervisor at once. 245.40(c)(4)(N)

    Does hiring follow Part 955?

    A registry check before hiring, the six web searches printed for the file, fingerprint deadlines, supervision while results are pending and a yearly registry verification. 955.165; 955.145

    Does abuse reporting include the investigation report?

    Remove an accused employee from client contact, write up the investigation within 14 days and send it to IDPH within 24 hours of finishing. 245.250(a)(3), (b)

    Does it promise only what the rule requires?

    The rule says you develop and follow your policies, and your own quarterly record review checks that established policies are followed. Every extra promise in a template is something you must also do. 245.210(d); 245.240(b)

Can an Illinois home services worker give or set up medications?

No. A home services worker may only remind: ask whether medications were taken, prompt, hand over or open a medication minder that the client, family, a nurse or a pharmacist has already filled and marked by day and time. Setting up medications is prohibited, and irregularities must be reported to the supervisor at once.

"A home services worker may assist a client with medication reminding only when medications have been pre-selected by the client, a family member, a nurse, or a pharmacist and are stored in containers other than the prescription bottles, such as medication minders."

Does Illinois require a TB test for home services workers?

It depends. Part 245 does not name a TB test for home services workers. It requires an initial health evaluation of each new employee with client contact, as specified by your governing body, and an employee health policy on reporting and removing staff with communicable disease. Your policy decides what the evaluation includes.

Can a new Illinois caregiver start work before fingerprint results come back?

It depends. Yes, conditionally, for up to three months, if the registry check and six web searches are clear and the worker has supervision enough to prevent abuse, neglect or theft. They must also finish 5 hours of training and pass a competency evaluation before the first assignment. Someone marked Ineligible on the registry cannot be hired.

Do you need a registered nurse to run an Illinois home services agency?

No. A home services agency designates a person to supervise services, and its supervisors and trainers need hands-on experience with home services tasks, not a nursing license. An RN or APRN supervisor is required for a home nursing agency, which is a different license.

Frequently asked questions

Does Illinois require written policies for a home care agency?

Yes. A home services agency needs written administrative policies and procedures that ensure clients receive safe and adequate care, adopted by its governing body (77 Ill. Adm. Code 245.30). Other sections of Part 245 and the background check rules in Part 955 name specific policies, such as complaint resolution, infection control, records, acceptance and discharge, and which positions are direct care.

Which policies do I send with the Illinois application?

The rule names seven policy areas for the initial application: complaint resolution, employee health and safety, infection control, background checks and mandated reporting, supervisory visits, client records and employee training. IDPH’s form names nine policies, splitting supervisory visits into clients and workers and adding client acceptance, and also asks for job descriptions, a sample service plan form, proof of insurance and proof of Health Care Worker Registry access. Every applicant also sends the client contract, a scope of services and a fee schedule. Grouped as policy areas, that is 14 areas of your manual.

How many policies does an Illinois home services agency need?

It depends on how you group them. We map 113 requirements from Part 245, Part 955, Part 973 and the related statutes onto 37 policies in 10 manual sections. A few apply only if you do that activity, such as bathing, transfers, medication reminding, dementia services, contractors or branch offices.

Who approves the policies, and how often are they reviewed?

The governing body adopts the agency’s policies and procedures and revises them as needed. It also reviews the bylaws every year, and your quality improvement program evaluates the whole program at least once a year, with a quarterly review of client records to check that policies are followed.

What do IDPH surveyors ask to see?

IDPH’s surveyor checklist lists policy and procedure manuals first, then bylaws, governing body minutes, client and employee lists, the liability certificate, the complaint log, training files, job descriptions, registry verifications, the license application, service plans and the dementia training curriculum. The agency manager or a designee must be available when the nurse surveyor arrives.

Where do Illinois home care agencies report suspected abuse?

For a client aged 60 or over, or an adult with a disability, notify the Adult Protective Services provider agency for the client’s area; the Department on Aging’s 24-hour hotline is 1-866-800-1409. For a client under 18, call the DCFS hotline at 1-800-25-ABUSE (1-800-252-2873). If an employee is accused, remove them from client contact, investigate, and send IDPH the written report within 24 hours of finishing.
